ARTMOXY LEGAL
These terms govern ARTMOXY software, website, account, membership, billing, AI, publishing, download, update, and support services.
These Terms govern access to and use of ARTMOXY, including its website, online Framing Studio (MoxyFrame), Library, Creative and MoxyAI tools, Workflows, Ad Materials, Artist Studio, Public View, account tools, membership system, artwork exports, and support resources.
By creating an account, purchasing a membership or credits, or using ARTMOXY, you agree to these Terms, the Privacy Policy, and the Refund Policy. You must be legally able to enter this agreement.
ARTMOXY is owned and operated by Global Development Solutions, LLC and is protected by intellectual-property and other applicable laws. ARTMOXY is licensed, not sold.
Your membership provides limited, revocable access according to its tier, membership term, account rules, and purchase terms.
Prices, included features, support periods, update eligibility, and promotional terms are shown at checkout. Taxes may be calculated based on billing information.
The annual subscription renews until canceled. Cancellation stops the next renewal but does not erase access already paid for during the current term. Refund requests are governed by the Refund Policy.
MoxyAI credits, sometimes called MoxyCoins, are limited service credits used for eligible online generation and Campaign actions. They are not cash, stored value, or transferable currency.
As between you and ARTMOXY, your work remains yours. You retain all ownership rights you already hold in artwork, photographs, prompts, references, branding, metadata, and other content you submit. To the extent permitted by applicable law, you own the exports, mockups, campaign materials, and other output created for you through ARTMOXY, and ARTMOXY assigns to you any right, title, and interest it may have in that output. ARTMOXY does not claim ownership merely because you used the service.
This ownership statement applies only as between you and ARTMOXY and does not grant rights in material belonging to someone else. You represent and warrant that you own, license, or otherwise have permission or a lawful basis to submit and use every input. Unauthorized use of copyrighted, trademarked, private, publicity-protected, or otherwise protected material may violate rights whether or not the violation is obvious, intentional, or detected by ARTMOXY.
MoxyAI output may be produced using OpenAI or another identified AI provider. AI output may not be unique, other users may receive similar output, and fully or substantially AI-generated material may not qualify for copyright or other exclusive protection in every jurisdiction. ARTMOXY does not guarantee exclusivity, copyrightability, registrability, non-infringement, marketplace compliance, or commercial suitability.
By using MoxyAI, you agree to comply with the then-current terms, usage policies, image-generation policies, and other applicable requirements of OpenAI and any other identified provider, in addition to these Terms. You are responsible for reviewing and honoring those requirements and may not use MoxyAI or its output in a way that violates them, applicable law, or third-party rights.
AI generation is probabilistic. Results may differ from prompts or references and may contain unexpected content, omissions, distortions, artifacts, or other defects. ARTMOXY applies quality controls and works to improve its generation workflows, but does not guarantee any particular result or subjective quality level.
Web MoxyAI uses ARTMOXY credits and may send prompts, artwork, and references to configured AI providers. Review every output before publication or sale. Unless the displayed retry or credit-release process applies, credits pay for the requested generation and related processing rather than acceptance of a particular result.
You may not use ARTMOXY to violate law, rights, platform rules, or the safety and integrity of the service.
Artwork Passports are artist-supplied authenticity and provenance records. The issuing artist is responsible for the accuracy of authorship, creation method, AI disclosure, edition, copyright, ownership, and transfer information. ARTMOXY records and displays those attestations but does not independently appraise, authenticate, insure, or guarantee an artwork, title, copyright, scarcity, market value, or legal ownership.
Issued certificates are designed as durable records. Corrections create a replacement record, revocations and disputes remain visible, and public provenance does not identify private holders. A current holder may initiate a transfer, but ownership changes only when the invited recipient accepts the claim.
AI-generated and AI-assisted works may receive Artwork Passports when accurately categorized. A certificate is evidence of the artist’s recorded attestation and file fingerprint, not a determination that an AI-involved work qualifies for copyright protection in any jurisdiction.
Global Development Solutions, LLC may limit, suspend, or revoke access when reasonably necessary to address payment failure, fraud, chargebacks, membership abuse, security threats, unlawful use, or violations of these Terms.
You may stop using ARTMOXY at any time. Account and content deletion requests are handled as described in the Privacy Policy, subject to legal, security, billing, and record-retention requirements.
Subject to section 13, you voluntarily accept risks of loss, corruption, deletion, disclosure, theft, unauthorized access, interruption, and permanent unavailability of data.
Keep complete, current, independently stored backups of your data outside ARTMOXY and verify restoration. ARTMOXY is not a backup, archival, or insurance service. Operational backups do not guarantee retention, recovery, or recovery timing unless agreed in writing.
Safeguard credentials, devices, and connected accounts; report unauthorized access through the Help Center.
ARTMOXY is provided as is and as available. To the fullest extent permitted by law, we disclaim warranties not expressly agreed in writing, including merchantability, fitness for a particular purpose, title, and non-infringement. No uninterrupted, error-free, secure service, results, compatibility, or data recovery is guaranteed.
To the fullest extent permitted by law, we are not responsible for interruptions or losses beyond our reasonable control, including disasters or network or provider failures. Cyberattacks, ransomware, theft, and unauthorized access qualify only to that extent.
Subject to section 13 and to the fullest extent permitted by law, Global Development Solutions, LLC, its officers, employees, agents, and providers exclude liability for the data risks in section 9, inability to use or recover data, replacement costs, and all resulting damages, including direct, indirect, consequential, business interruption, and lost profits or revenue. This applies under any theory, including ordinary negligence, even if foreseeable.
Total aggregate liability for all ARTMOXY-related claims is capped at the greater of US $100 or your affected-service payments during the 12 months immediately before the event. Related claims share one cap. Express Refund Policy entitlements remain. Unenforceable provisions do not affect remaining lawful provisions.
Nothing limits liability where prohibited by law, including for fraud, willful misconduct, gross negligence, death or personal injury. Nothing waives mandatory consumer remedies, privacy rights, or security or breach-notification duties. The Privacy Policy applies.
Material changes are versioned, dated, and prospective after required notice and agreement. Publication does not by itself establish your agreement. Acceptance and accrued rights are not retroactively rewritten.
